Terms of Service

These Terms of Service ("Terms") govern your access to and use of makesPDF (the "Service"), operated by Eight Degrees Off Center ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
makesPDF is a PDF generation service. You submit content (Markdown, template definitions, or other supported input) via our web application or HTTP API, and we return a rendered PDF document. Details of features and supported input formats are described in our documentation.
2. Accounts
You must create an account to use the Service. You are responsible for keeping your login credentials and API keys confidential and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised access.
You must be at least 16 years old (or the minimum age required to consent to online services in your jurisdiction, if higher) to create an account.
3. Acceptable use
You agree not to:
- Use the Service to generate or distribute unlawful, defamatory, or infringing content;
- Attempt to bypass rate limits, quotas, authentication, or billing controls;
- Reverse engineer, scrape, or interfere with the Service beyond what the API documents allow;
- Resell the Service or expose it as a white-label product without written permission;
- Use the Service to transmit malware, phishing content, or other material that harms users or systems;
- Submit content that infringes the intellectual-property or privacy rights of third parties.
We may suspend or terminate accounts that violate these rules, with or without notice.
4. Content and intellectual property
You retain all rights to content you submit ("Your Content"). You grant us a limited, non-exclusive, worldwide licence to process, store temporarily, and render Your Content solely to provide the Service to you. We do not claim ownership of Your Content and do not use it to train machine-learning models.
The Service itself, including the makesPDF software, website, and trademarks, remains our property and is protected by applicable intellectual-property law.
5. Fees and payment
Current plans and prices are listed on our pricing page. Payments are processed by Stripe. By subscribing to a paid plan you authorise recurring charges to your payment method at the interval described for that plan (monthly or annually), and for any enabled top-up purchases.
Credits are consumed per PDF rendered (1 credit = up to 10 pages). Free-plan renders include a watermark. Unused monthly credits do not carry over. One-time top-up credits remain in your wallet until used.
If a payment fails we may suspend paid features until the balance is resolved. You may cancel a subscription at any time from the billing settings; cancellation takes effect at the end of the current billing period and does not entitle you to a refund of fees already paid, except as required by law.
Prices are exclusive of taxes unless stated otherwise. Where required by law, taxes are calculated and collected at checkout.
6. Service availability
We aim to keep the Service running reliably but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for any downtime, data loss, or inability to render caused by circumstances outside our reasonable control.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that rendered output will meet every accessibility, regulatory, or archival requirement you may have; it is your responsibility to validate output for your use case.
8. Limitation of liability
To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Termination
You may close your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms, if required by law, or on reasonable notice if we discontinue the Service. On termination, your right to use the Service ends immediately; sections intended to survive (including Content and intellectual property, Disclaimers, Limitation of liability, and Governing law) will survive.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws in force in Queensland, Australia, without regard to conflict-of-laws principles. The courts of Queensland, Australia have exclusive jurisdiction over any disputes arising out of or related to these Terms or the Service, subject to any mandatory consumer-protection rights you have under the law of your country of residence.
